Tampering with computer source documents [section 65]:

This section provides for punishment upto three years or with a fine which may extend upto Rs. 2lakhs or with both whover knowingly or intentionally tampers with the computer code source documents. Computer Source Code means the listing of programmes, computer commands, design and layout and programme analysis of computer resource in any form.
Hacking with computer system [section 66]:
Hacking is a term used to describe the act of destroying or deleting or altering any information residing in a computer resource or diminishing its value or utility, or affecting it injuriously in spite of knowing that such action is likely to cause wrongful loss or damage to the public or that person. Section 66 provides that a person who commits hacking shall be punished with a fine upto Rs. 2lakhs or with imprisonment upto 3lakhs, or with both.
Publishing of information which is obscene in electronic form [section 67]:
Section 67 provides for punishment to whoever transmits or publishes or causes to be published or transmitted, any material which is obscene in electronic form with imprisonment for a term which may extend to 5 years and with fine which may extend to Rs. 1lakh on first conviction. In the event of second or subsequent conviction the imprisonment would be for a term which may extend to ten years and fine which may extend to Rs. 2lakhs.
Power of the Controller [section 68 & 69]:
Section 68 provides that the controller may give directions to a Certifying Authority or any employee of such authority to take such measures or cease carrying on such activities as specified in the order, so as to ensure compliance with this law. If any person fails to comply, he shall be liable to imprisonmet upto 3 years or fine upto Rs. 2lakhs, or both.
Section 69 empowers the controller, if he is satisfied that it is necessary or expedient so to do in the interest of sovereignty and integrity of India, security of the State, friendly relation with foreign states or public order, to intercept any information transmitted through any computer system or computer network
Powers of the Government [section 70]:
Section 70 empowers the government to declare by notification any computer, computer system or computer network to be a protected system. Any unauthorised access of such systems will be punishable with imprisonment which may extend to ten years or with fine.
Penalty for Misrepresentation [section 71]:
This section provides that any person found misrepresenting or suppressing any material fact from the Controller or the Certifying Authority shall be punished with imprisonment for a term which may extend to 2 years or with fine which may extend to Rs. 1lakh or with both.
Penalty for breach of confidentiality [section 72]:
Section 72 provides a punishment for breach of confidentiality and privacy of electronic records, books, information etc. by a person who has access to them without the consent of the person to whom they belong with imprisonment for a term which may extend to 2 years or with a fine which may extend to Rs. 1lakh or with both.
Penalty for publishing false Digital Signature Certificate [section 73]:
This section provides punishment for publishing a Digital Signature Certificate false in material particulars or otherwise making it available to any other person with imprisonment for a term which may extend to 2 years or with fine which may extend to Rs. 1lakh or with both.
Penalty for fraudulent publication [section 74]:
This section provides for punishment with imprisonment for a term which may extend to 2 years or with fine which may extend to Rs. 1lakh or with both to a person whoever knowingly publishes for fraudulent purpose any Digital Signature Certificate.
Act to apply for offence committed outside India [section 75]:
Section 75 provides for punishment for commission of any offence or contravention by a person outside India irrespective of his nationality if the act or conduct constituting the offence or contravention involves a computer, computer system or computer network located in India.
Confiscation [section 76]:
This section provides for confiscation of any computer, computer system, floppies, compact discs, tape drives or any other accessories related thereto in respect of contravention of any provision of the Act, rules, regulations or orders made thereunder.
It also provided that where it is established to the satisfaction of the court adjudicating the confiscation that the person in whose possession, power, or control of any such computer, computer system, floppies, compact disks, tape drives or any other accessories relating thereto is found is not responsible for the contravention of the provisions of the Act, rules, orders or regulations made thereunder, the court may, instead of making an order for confiscation of such computer, computer system, floppies, compact disks, tape drives or any other accessories related thereto, make such other order authorised by this Act against the person contavening the provisions of this Act, rules, orders or regulations made thereunder as it may think fit.
Non interference with other Acts [section 77]:
Section 77 further provides that penalty and confiscation provided under this Act shall not interfere with other punishments provided under any other law for the time being in force.
Power to investigate [section 78]:
Section 78 provides for power to investigate the offences under the Act by a police officer not below the rank of Deputy Superintendent of Police.
